Your rights when getting pulled over...?

I know that there is a thread kinda of like this, where everyone talks about their experiences  when being pulled over. The reason i started this thread is because when my car was all done up. I've been followed by under covers and pulled over several of times for some of the lamest reason and not given a ticket.

Yesterday morning i was on my way to work, its was about 6:30. Im about 2 blocks from my house and Sheriff passes me going the opposite way. In my head i was like i bet he flips a u-turn. And guess what he sure did. Oh by the way my car is bone stock! At this point im at a stop sign, l look in my review and he's running my plates. Then he follows me for about a quarter of a mile and turns off. And i continue on my way to work.

So if you know you're clean, and they pull you over just to pretty much harass you. You can't fly off at the mouth because that then give them a reason to make you get out the car. Its almost like they can do what f*** they want! And i sure don't want to end up like Sean Bell.

Guys and girls that share my frustration please shed some light on this for me. Thanks

I ride "dirty" but I've been getting pulled over and harassed more times then I ever have in my life and let go w/ no tickets. And it's only around my block, every where else cops leav me alone........but I'm w/ you, I ain't tryna have any Sean Bell BI so I keep my mouth shut to a point!
Whata ya gonna do though.........COPS GOT GUNS!

When I get pulled over it often makes me think that I should jus sell my car, stop doin VIP and by a truck (cause I really want a truck). But then I know that won't solve a thang guys no matter what car I drive I HAVE to modify it. I jus can't stand stockness to the highest degree...........makes me feel inscure!

I hate to say this as a cop out but it was because im a young black guy in a nice car. But thats what it felt like. The time i got followed by the undercovers i was on my way from work.

They can't search your car without probable cause, and you don't have to pop your hood when asked. If they ask to search your car, you can tell them no. They have to get a warrant. If your car is clean, tell them no. Ask them why they pulled you over, and if they can't give a reason, ask them again, why did they pull you over then.  It's life, but if you aren't  in the wrong, they can't give you any shit.

No matter what people may say or think it is!
The last time I got pulled over, the cop asked me who's car is this.
Another time the cop said we've never pulled over a car like this.
And I have also gotten pulled over coming home from work all suited and booted!

Yo I know most of what they can and can't do and I ain't know bitch and will let them know when they wrong but I really ain't tryna end up in no Police Drama! Most of the time it's best to jjus shut the hell up and let them do they thang! PICK your battles!

Pancakes, you are so right about that! Ive heard of cops doing stuff like that. But man what a lawsuit that would be on there department.

I hate to play a race card too, but it can be a factor. Especially when they tend to profile 'suspicious' characters, and who knows, they may just be doing their job, you know, looking out for drug dealers and such. Sometimes you just gotta give them the benefit of the doubt. If you are clean, and they think you are a dealer, ask them why they pulled you over, chat it up with them, see if they are interested in cars and shit, explain the style, that it's not to be 'gangster', but it just looks so damned good....shit like that. LOL.

Police are corrupt there's always loop holes around for them.

You dont have to agree to much anything a cop wants from you, unless they have already arrested you or they present you a warrant.  I have been pulled over in many of my cars for stupid crap, and made the mistake once of agreeing to a field sobriety test cause I was sober...  I failed because it was 35 degrees and raining out and i was in pajamas.  Blew 1/3 the legal limit but was still given a misdemeanor.  It was dropped after $5000 to a lawyer and he gave me a lesson on what I was required and not required to do when being pulled over.  They also proceded to tow my Audi out of my garage it was parked in and impound it(I was originally pulled over for not signaling when turning into my driveway.........)

golfkid777, that is a crazy story wow! Is that legal for them to tow it out of your garage? I would have closed the garage door on them.

That's incorrect.  You HAVE to pop the hood when asked, it's the law.  You don't have to let them search your car/trunk but you must open the hood.

I think the most important thing when getting pulled over is to remember the 5th amendment.  If the cop asks you how fast you were going, why the hell would you say "just 5 over the speed limit"?  You just admitted to speeding.  STFU and remember that you don't have to answer anything.  Give him your paperwork and sit tight.

Once they arrest you they can do pretty much what they want.  But if you refuse to give them everything they ask for, they have no reason to arrest you, in which case you would be wrongfully arrested and a nice settlement could be reached with the city on that.

I made the mistake of thinking I could 'prove' my innocence, when in reality I WAS innocent.  And they had to prove me guilty.  Caulk it up for misknowledge as a learning experience....  I have been asked a few times since to search the car/ perform tests/ open the trunk, hood.  I politely refuse and am left alone.  Most cops believe they can coerse anyone they pull over into being their bitch, and when you are polite about everything but merely show you have a lot more knowledge than the next guy, they will revert to their lazy ways and leave you alone in hopes of finding the dumb that doesnt take as much work, and comes with a lot less risk.

As far as this subject is it written anywhere what exactly your rights are?

No you don't. They have to have probable cause. Pulling you over because your car is too low, and them asking you to pop the hood are two different things. Speeding and them asking you to pop the hood are two different things.  Exhibition of speed, and/or racing, is another story. They've got probable cause. Going through a sobriety check point, is not probably cause for them to pop your hood. 

You don't have to consent to them searching the car, that includes the engine bay. Whoever told you otherwise is misinformed. They HAVE to produce a search warrant in any case if you say no. They can hold you/your car there until they get one, but do you think a judge is going to grant one being called at 1 am because the cop pulled someone over for their car being too low/no front plate? It's still illegal search and seizure if you don't consent and they don't have a warrant.

In the constitution.  You are innocent until proven guilty.  You are the only one who can prove you are guilty(90% or so of the time).  If you do not consent to anything they ask, they will properly let you know what you do and dont have a choice about, just dont fall for their threats and or gimmicks.  They will try and "convince" you of what you can and cant do, but if you are polite and firm, they will either let you know what you have to do or not have to do or just arrest you and do their own thing.  Thats a lot more likely if you happen to appear in a manor that would lead them to believe you do not have the funds(or know how to hire a lawyer and fight them if they do find something.

My lawyer has told me of cases where this has been assumed and clients have been wrongfully arrested/pulled over without cause.  On multiple occasions he has relieved officers of their duties and had his clients awarded nice settlements due to the actions of the police.

Believe me when I say I have dealt enough in my life with the legal system... And one thing I have learned is that when law is taken into the hands of cops out of context, its the quickest way possible to piss a judge off.

this is what you can do.....you know your clean and you got alil time on your hands...ask for his onduty suspervisor before you show him anything and then when his boss has to get lazy a@@ up and drive all the way down to you and finds that you didnt  do something wrong ...its a wrap for that cop and then you ask the for there badge number and keep it on record and if the same cop pulls you over more then twice its a harrassment case...i got alot of ticket tossed out that way.....i let them know that i'll be recording the police stop on my cell...and when they understand that they cant just run yah over they will leave you alone.......Or...Kill you....but hey see what happens...(results may vary)

If asked to pop the hood, you can say, "No."  However, if anyone is on probation or parole, your rights are taken from you and they can search almost anything they want.

Why are any of you guys even worried to pop your hoods?
Unless you got drugs or weapons in there then you should be straight!
No reason to have turbos/superchargers on these things...

Oh yeah, good point Siphan, I forgot about the whole on probation/parole...you have no rights when it comes to getting pulled over.

Just move to Canada. :p

Unless you're mouthy or racing, you're fine, even if you do get pulled over. And as long as you're not at fault, tickets are a piece of cake to get thrown out.

Go ahead and say no if they ask you to open the hood.  It's refusal to obey to to a lawful order or however they word it.  Saying no to letting a cop search your interior/trunk != saying no to letting a cop search your engine bay.

Most cops will confuse you into answering one question example:

"You dont have nothing illegal in the car?You dont mind if i search it?"
Once you say no you answered both questions.
What you say is "ociffer i gots nothin illegal and i do mind if you search my car" Then start dancing:runcoold:
