The battery is brand new... we replaced it last week when we cleaned out the throttlebody... I would take a hammer to it but isn't the starter in under the intake manifold?

yes it is...and its a pain to change out also. i speak from experience, its a good 6-10hr job because the amount of stuff u have to move out of the way and also the starter bolts are hidden. so u have to remove the top part of the wire harness, then remove the rear coolant bypass then ur able to get the starter out...breaking the bolts were also fun with the limited space.

Dang that sucks... well that's the job I have to tackle tomorrow.. just wanted to be 100% sure it was the starter.

Try to jump start it first and see if it would turn over.
Another way to try to get the starter unstuck is turn the ignition to "on" position and put the car in drive. Have someone push the car and try to turn the key to start. This will cause the starter gear to touch the flywheel making the starter gear spin.
Hope this helps a little.

LiCelsior - Yep we had to replace those.
Garage7RP - the start was GONE whe we took it off
DONE! And let me tell you i never ever want to do that again! the job took us about 7 hours to complete sigh*. So we disconnected everything and took everything out from around the intake manifold. It was a bitch because the all of the plastics and rubber hose were pretty much hard and everytime we tried to move the engine wire harness out of the way... te plastic will crack. Also had to replace a few hoses because some cracked. SO finally we got to the starter and DAMN! It took us nearly an hour just to take off the bolts. Idk why they engineered the car like that but why didnt they make the bolts facing inside out. well we end up using #14 wrench and took it out by hand. WE cleaned out all the dirt from the old gaskets and replaced them with new ones. So we are putting everything back together and we got all of the intake manifold back on and all the egr valves on and we are about 20mins away from beeing done. Then when i was going to put the #10 coil bolt back on i dropped it into the timing cover FML!!!!!!!!!!!! Idk what iw as thinking i should have covered the timing covers up but noooo. So we tried for about 30mins with a magnet to see if we can get the bolt back out but no luck. We had to tear off all the front pulleys, radiator and also the balancer to get to the bottom cover and once we got that it was at the very bottom. FML!!!!! but we manage to pull thru over all now the car starts up fine. SIGH*
