Issue regarding Gato (Marketplace)
Wasn't really sure where to put this thread... but I'm going to be as brief but as descriptive as I can.
Gato posted Tommy's old Work SC5s for sale, I spotted them and passed them along to a friend who is not on VSC or Club Lexus. A deal was negotiated and agreed upon to have the wheels shipped to my American address in New York. Paid and awaited shipment.
Drive down to the border, (about 2 hours) and pick up the wheels. When we got there, the wheels were not at all in the condition that Gato described. He said all of them were in great shape and one wheel had a very minor rash on "not a big deal" this however was not the case. Keep in mind, I buy and sell many wheels and I ALWAYS check the packaging to see if it has been damaged. All of the wheels at least have a handful of dings in them and the "minor rash" is actually about 3.5" and deep into the lip. Not to mention one of the tires said to have 70% to 80% life left has a separated sidewall and a bubble the size of my fist. Anyone that knows anything about tires knows that you can not separate a sidewall when there is no load on the tire, AKA it was there prior to shipment.
So, since we were 2 hours from home and in a different country it's not like we can reject the wheels and send them back. So we take them home and send Gato an email explaining the situation. He was very co-operative at first and agreed that sometimes perception of good condition can be skewed. However, a damaged tire is still an unusable one. Jeff (buyer) and Gato settled on an amount to refund given American trade value of what a tire and wheel refinishing is. (for example, a nexen tire for Americans is $115, my price for the same tire $210) X amount of money was agreed on to be refunded. This was the 18th of April. I have contacted his vouchers and posted in his FS thread.
At this point, we haven't heard from Gato and I'm tired of dealing with it since every response we DO get looks something like this "this is BS, I dont even knw why im repliying since you come off dissrespectful in your post. i have a looong list of back n forth emails from JEff. and this isnt come up with any shit to get money back. ive offered a refund to jeff but i guess yall lboth think you can tell me what to do and what to pay. and its not even about the money now...simple for yall s manerism and dissrespectfullness. they were used wheels."

So basically how I'm looking at this to sum it up is
1. The wheels were damaged before they left Texas
2. We were lied to about the tires and condition
3. If they WERE damaged in transit (both wheels and tires) the seller should have packed them better.
4. Tired of the run around waiting 10 or more days for every email even though they are going right to his phone.
5. Is now saying, we should have requested detailed images of the wheels. Basically saying, you should have trusted me, deal with it.
6. It's not so much the lips Jeff is worried about, it's the tire. The Agreed amount of money was to cover the tire at the American cost plus install.
Anyways, here's some photos.

The wheels have quite a lot of these, some small some large. But definitely not mint lips.

This is a dent and then a flat spot on the lip that spans several inches. Potentially from a poor sanding?

This is a pretty bad gouge, but this is what I would pass as the "small rash"

i had that problem with RASRX7 too aka ron sino cruz...sold me a set of wheels which he describe "immaculate" and shown with only one small pic. i asked for close up he said that is all he has. when i got it all my car friends and i agree it is "rotten" condition...needless to say not only that was the last thing i bought from him...it was the last set of wheels i bought used...i guess there is only one way to describe "new" and there are alot of gray area to describe them when it is "used"

looks like minor curb rash was described, although the bubbled tire was not... I'm not understanding your wanting him to refinish the wheel when it was described as minor curb rash? The tire, I can definitely see...that's a huge bubble! BTW, 18th of May hasn't happened yet unless this took place last year??

No, jeff has accepted that Gato screwed him on the condition but can't really say anything because it is a perception of condition. The tire however needs to be paid for which Gato agreed to do, but has not done so.

We never said we want more, we want what was initially agreed upon. As I said above, the damage to the wheels is a perception, I guess some people just don't give a shit about how things look and don't understand the words not a big deal or barely noticeable.
The tire is what needs to be covered, we were nice enough to offer the refund at American pricing even though here in Canada we would pay about $100 more for the exact same tire, but re and re on the tire.

I don't think it's fair to say that Gato screwed him on the condition of the wheels. There was a misunderstanding yes, but in no way has Gato been deceptive in his representation.
If you buy a used car, drive it off the lot, get home and notice a paint defect or tear in the seats, are you going to say the dealer screwed you?

That's a little different though isn't it? neither of us saw the wheels and went with them on good faith from what I thought to be a well respected member of the forum. If I had picked them up in person I wouldn't have bought them personally. Misunderstanding or not, his perception of great shape is a very vague one.
But waijai, for the third time. Jeff is no longer concerned with the mangled lips, he needs to get the tire covered and Gato has been ignoring him. He has not been chasing him for lip refinishing. He really should not be chasing him at all, he has already agreed to pay back some money but has not done so. It's really bad that I can't trust a 5 year member of VSC and of Refined Elegance to tell the truth about something he's selling.

I don't think it's any different. If I bought a car from out of state and had it shipped to my house, I would either fly out to pick up myself or get 1000 pictures of every single part of the car.
Hope this gets resolved. Gato has always been a stand up guy on here and in person. I would ALWAYS ask for close up shots of every single wheel when buying used. People's perception of "great shape" might not be the same as it is for me.
Also, it's been one week. Don't you think it's a little early to feel "shafted?"

Just to make this apparent, I don't get anything out of this. If money goes back to Jeff that's great, but no money comes to me. I'm am merely the one that set up the deal so i feel he's screwed me, which is not acceptable.

You're missing my point. With any transaction of used goods, it's buyer beware. I'm saying it's not fair to say Gato screwed your friend on condition of wheels b/c your friend assumed flawless, perfect wheels when they were USED.

They did have a bit more rash than I was hoping, but I felt I got them for a fair enough price and they are "used". I was not unhappy with him, his shipping time, or anything at all. He has even contacted me several times since transaction to confirm I'm happy and to ask about my car/build.

So...I just purchased a set of 7 series wheels from Gato about a month ago. He was quickly and friendly to PM/text/talk on the phone. Price was fair, he was honest about the condition of the rims. They did have a bit more rash than I was hoping, but I felt I got them for a fair enough price and they are "used". I was not unhappy with him, his shipping time, or anything at all. He has even contacted me several times since transaction to confirm I'm happy and to ask about my car/build.

Ok, so I sell you a set of wheels, with tires that you think are in good DRIVABLE shape. right before I ship them I'm cutting a piece of tape and the knife slides off and punctures the tire, I ship them anyways.
Is that your fault that you now have one completely useless tire? Because right now you're saying it is.
Buyer beware...of what? He sold a faulted product and won't back it up. Hence why were here with this thread, something needs to be done about his poor representation of the product. He sold a wheel with a useless tire at full value. If I didn't want the tires, I would have bought the wheels at the discounted price without tires, wouldn't you? And if I had known the tires had a 5" bubble I would have bought them without the tires.

I know 4DGS personally and know he's not the type of guy screw anyone over. Just the opposite he has helped me out immensely with nothing for him to gain from it.

In my opinion that means pretty much unnoticeable. But I guess very minor and pretty brutal can get mixed up here and there.

I do understand where the buyer is coming from, since he did pay top dollar for some expensive wheels.
but gato did disclose "some minor scratches"....and if each little scuff is on each wheel then it's not that bad. if all of it was on one wheel then that's another story.
the tire on the other hand was definitely not disclosed and yeah maybe gato did not see it.
gato refunded hundred something dollars so I think this disagreement should be resolved and both parties should move on.
either way hope you guys can come to a happy conclusion.

Well..... Reading this still 2:51 is interesting.
I would pay back the Canadian amount G. and wipe you hands clean. the Scratches on the lips would have had me pissed IMO. and the tire is only the cherry on top. and seems like this can be all done fellas.
I am a stand up seller and I can look at both sides. but over all When a refund is issued then everyone can go about their day and move on. This was a high dollar sale aswell.

Honestly, if I were selling them and I can truly say I was not aware of the bubble then I wouldn't refund anything. Again, I would not lie about, and if I did know it was there I would list it in my thread. With that said, that bubble would be pretty hard to miss.
Secondly, I've been in a similar situation. I bought wheels from a vendor on here a long time ago with "minor curbage and nothing major." I had to pay to refinish every single wheel I learned a valuable lesson not to trust someone on here (or any place for that matter) just because they are well known or a paying sponsor. However, I didn’t come on here and make a big deal out of this because in the end it was MY FAULT for not asking up close shots of each wheel displaying damage. I’ve sold wheels on here and people always ask for detailed pics, which I have no problem providing since I’m pretty upfront about what I post on here.
Lastly, when dropping $3,000 on wheels why make big fuzz over $100? This just seems petty and to me the only reason $100 are being sought after so badly is because the buyer wasn’t satisfied with a used product he should have been more careful about buying instead of having a middle man do all he work for him. Those tires will probably last a couple months until they need to be changed. The term minor curbage is debatable to say the least and you shouldn't take anyone’s word for it. Charge it to game, take it as a loss, lesson learned and lets all get the hell on. That's just my .02.

tires have bubbled on me during shipping before - twice buying new tires, once when shipping wheels with tires to someone. the tires do not necessarily have to be under load to incur damage. transport carriers are not at all gentle with packages. this is a freight carrier issue (imo) and if it was fully insured i would have filed a damage claim immediately. i take pics of all high dollar items i ship before/during/after they are packed to cover my ass.
its too much bickering for 3% of used parts. it doesnt seem worth the stress (for either party), but thats me. im sure gato will settle it though. gl to those involved.

i am sure he will ... but the point respond and not ignore to his emails , I manage a transport company with over 10 years of freight exp , i have never seen tires bubble in transit that is a bunch of BS ,maybe he did not see the bubble i could accept that , those wheels were not driven on since they got here there is still snow on the ground in some places .As far as shipping goes they faces could have been damaged in shipping but not the tires.I know you are in the same line of business as my self but be neutral to the issue at hand.

I do agree with you James BUT i have bought almost 10 sets of wheels and parts from the US over the last 2 years and i have never had this problem.

I can call out a lot of instances of this. From seller to buyer to insurance fraud to Craigslist sellers, and buyers, stealing all sorts..
My question to all of this is, was there any detail of the damages? if there was, and it was new, or not shown, i would understand. If i was to go that far for wheels i would ask of this.
