BART Police fatally shoots man in back while cuffed-Family sues for $25 million
OAKLAND, Calif.—Family members of a 22-year-old man fatally shot by a transit officer on New Year's Day have filed a $25 million wrongful death claim against the Bay Area Rapid Transit agency.
The claim sent Tuesday to BART alleges illegal seizure and excessive force were used in Oscar Grant's death.
Attorney John Burris says Grant's civil rights were violated and he posed no threat when he was shot on the platform in Oakland after BART police responded to a report of a fight.
BART has 45 days to accept or reject the claim. Spokesman Linton Johnson says transit officials are reviewing the claim.
The officer involved in the shooting is identified in the claim as Johannes Mehserle. Calls to his attorney, David E. Mastagni, were not immediately returned.

It's unfortunate that something like this has happened but I honestly believe $25-million is quite excessive.

Finally some good news on this situation and I agree VI IX who's to say what amount is excessive no matter what they ask for or receive Oscar Grant's not coming back...and I hope they dont let another Rodney King type verdict come about I could see that being real ugly especially since this kid is dead

If you have seen what has been done by the riot, you would know how I feel about it. They needed to do this because another protest is planned to occur tomorrow in Oakland. But who knows maybe the protest might end up turning into a riot tomorrow anyways.
It's oaktown so I wouldn't doubt a riot breaks out. Be more surprising to see one not break out!

Or was he trying to pull the gun out to try to "scare" the guy so he wouldnt fight and it accidentally went off.

Still in court. Judge put a $3M bail which I don't think he deserves. KTVU always has the latest on the shooting.

i dont think there will be anything like rodney king in today's times, the people have become quite passive on matters relating to police injustice on minorites,,,, sean bell, amadou dialo, etc. and the list goes one... we need unity, but the mental washing has caused so much division amongst the bretheren that it has come to my attention that many people just see it as, it isnt my problem...
idk but the great Rev. MLK Jr. once said, a threat to injustice anywhere is a threat to injustice everywhere... seriously what has become of my/our generation?

Over a decade ago, a police officer chased a man into traffic and shot and killed him (during rush hour traffic). Riots ensued resulting in one, if not two, local news vans catching on fire. This happened while I was still in middle school. On a random note, the majority of white kids at my school did not show up the next day. For about two weeks since the shooting, fights would occur often and it seemed like it was racially motivated. When I think back at it, it seemed more like riots. It was definitely out of control.

In his own court filing asking for bail for Mehserle, Rains said Mehserle "simply wishes to be released from a small, windowless room he occupies on a daily basis for 23 hours in order to re-unite with his family and be able to effectively prepare for the defense of this matter."
He probably should have considered that before putting Grant in a small, windowless box, for 24 hours a day, forever.
